OhMyGPT provides text generation and AI image generation services. These services are accessible through https://www.ohmygpt.com and related API endpoints. Future additional services may include AI knowledge bases, Q&A services, AI translation, intelligent content search, and more.

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian to use the Service.

  1. You agree not to share, transfer, sell, or in any way abuse your account privileges.
  2. You are responsible for all activities that occur under your account.
  3. Users need to maintain a positive balance to continue using the services. Account balances operate on a pay-as-you-go basis, charged according to AI resource usage.
  4. Users agree to a no-refund policy unless the Company is unable to continue providing services due to force majeure.
  5. You agree to comply with all applicable laws, rules, and regulations when using the Service and will not engage in or use the Service for any illegal activities.
  6. You agree not to conduct any systematic or automated data collection activities on our services.

User Data

Intellectual Property

The AI models deployed in our services are provided by third parties such as OpenAI. The Company currently does not have the capability to produce proprietary AI models.

Regarding assets generated by our AI image services, you retain ownership while granting DogeNet LLC rights as described in the following paragraph:

Rights You Grant to DogeNet LLC

By using the Service, you grant DogeNet LLC and its successors and assigns a perpetual, worldwide, non-exclusive, sublicensable, royalty-free, irrevocable copyright license to reproduce, prepare derivative works, publicly display, publicly perform, sublicense, and distribute text and image prompts you input into the Service, or assets generated by the Service according to your instructions. This license survives termination of this Agreement for any reason by either party.

Your Rights

Subject to the above license, you own all assets created using the Service, provided these assets were created in accordance with this Agreement. This does not apply to upscaling of others' images, which remain the property of the original asset creators.

Third-Party Links or Integrations

Our services use Google Analytics and Stripe. Google Analytics is used for website activity and data tracking, and Stripe is used for payment processing, which may require user data (such as email, address, and IP) for anti-fraud verification and facilitating successful transactions.

Termination

We reserve the right to block or suspend user accounts when we detect any of the following activities:

  1. Abusing platform vulnerabilities to illegally obtain rewards.
  2. Malicious attacks on our website or services causing abnormalities or losses.
  3. Unauthorized use of private or reverse APIs.
  4. Any other behavior that may cause harm to our services or users.

Limitation of Liability

Under no circumstances shall DogeNet LLC, its affiliates, partners, and employees be liable for any direct or indirect damages or losses related to these services. Use of OhMyGPT services is at the user's sole discretion and risk.

Users shall indemnify and hold harmless DogeNet LLC and all related parties from any claims, liabilities, costs, or demands arising from misuse, illegal use, or improper use.

Changes

DogeNet LLC reserves the right to change these Terms at any time. If the changes are material, we will provide 30 days' notice before the new Terms take effect. Continued use of or access to our services after posting these changes will be deemed acceptance of these changes.
